By purchasing, receiving, installing, or displaying artwork from Metal Memories LLC, the customer acknowledges and agrees to the following terms:

1. Nature of Artwork and Safety: Metal Memories LLC creates custom, handcrafted metal artwork, sculptures, and decorative pieces. Due to the nature of metal materials, certain pieces may be heavy, contain sharp or irregular edges, have protruding components, or present risks if improperly handled, mounted, moved, or displayed. Customers acknowledge these inherent characteristics and agree to exercise appropriate care and caution.

2. Customer Responsibility: Upon delivery and acceptance of the artwork, the customer assumes responsibility for its proper handling, placement, maintenance, and use. Customers are responsible for ensuring that artwork is securely positioned, appropriately supported, and kept away from hazardous locations or situations where it may fall, tip, or cause injury.

3. Installation and Mounting: Unless otherwise agreed upon in writing, Metal Memories LLC is not responsible for installation, mounting, anchoring, or structural support of purchased artwork. Customers should consult qualified professionals when installing heavy, suspended, elevated, or wall-mounted pieces. Artwork must never be installed in a manner that creates an unreasonable risk of falling, tipping, or causing injury.

4. Limitation of Liability: To the fullest extent permitted by applicable law, Metal Memories LLC shall not be liable for injuries, accidents, or property damage resulting from improper handling, installation, mounting, relocation, modification, misuse, or failure to maintain artwork after delivery. Nothing in these terms excludes or limits liability that cannot legally be excluded, including liability arising from defective products or other legally actionable conduct.

5. Handmade Characteristics: Each artwork is individually handcrafted and may contain variations in texture, finish, color, weld appearance, and other artistic characteristics. These variations are part of the unique nature of handmade metal art and do not necessarily constitute defects.

6. Maintenance and Environmental Exposure: Customers are responsible for reasonable maintenance and care. Metal artwork may develop rust, patina, discoloration, or other changes over time, particularly when exposed to moisture, sunlight, or outdoor conditions. Customers should follow any care instructions provided by Metal Memories LLC.

7. Custom Orders and Sales: Because artwork is often custom-made, commissioned orders may be nonrefundable once fabrication has begun, subject to the specific purchase agreement and applicable consumer protection laws. Any cancellation, refund, or modification requests must be reviewed and approved in writing.

8. Intended Use: Unless expressly designated otherwise in writing, Metal Memories artwork is intended for decorative or artistic purposes only. It is not designed for climbing, sitting, standing, hanging from, or use as playground equipment, structural support, or safety equipment. Customers should supervise children and pets around artwork where appropriate.

9. Alterations and Repairs: Metal Memories LLC is not responsible for damage or safety issues caused by unauthorized alterations, repairs, or modifications made after delivery.

10. Acceptance of Terms: By completing a purchase, the customer acknowledges that they have reviewed these terms, understand the potential risks associated with metal artwork, and agree to follow all applicable safety, installation, and maintenance instructions.

1. Business Information

This company is operated by Metal Memories LLC, doing business as Built By Coffee.

These Terms & Conditions govern purchases made through our website and your use of its content and services.

By placing an order, you agree to these Terms & Conditions, subject to applicable consumer protection laws.

2. Products and Availability

Built By Coffee offers packaged coffee products, including whole-bean coffee, for personal consumption.

Product descriptions, roast profiles, tasting notes, and photographs are provided to help customers make informed purchasing decisions. Natural variations between coffee batches may occur.

Products are subject to availability. We reserve the right to discontinue products, correct listing errors, or decline orders for legitimate business reasons, subject to applicable law.

3. Pricing, Orders, and Payments

All prices are displayed in U.S. dollars.

Customers are responsible for the product price, applicable shipping charges, and any taxes required by law. The total amount payable will be displayed before the customer completes checkout.

Payments are processed through the secure payment services available on our website.

An automated order confirmation acknowledges receipt of an order but does not guarantee product availability. If an order cannot be accepted or fulfilled, any payment collected for the canceled items will be refunded.

4. Sales Tax

Qualifying packaged coffee products sold for human consumption are generally exempt from California sales and use tax under California Revenue and Taxation Code § 6359, including subsections (a) and (b)(1), and California Code of Regulations, Title 18, § 1602.

For purchases shipped outside California, applicable sales or use tax may be collected where required by state or local law.

Tax treatment may vary depending on product type, shipping destination, and applicable law. Any tax collected will be identified during checkout.

5. Shipping and Fulfillment

Built By Coffee ships to eligible addresses within the United States.

Orders may be prepared, packaged, and shipped by authorized third-party roasting and fulfillment partners on our behalf.

Shipping charges are calculated and displayed during checkout. Shipping options and availability may vary based on destination, product quantities, and carrier service.

Estimated processing and delivery times are not guaranteed delivery dates. Orders containing multiple products may be shipped in separate packages.

Customers will receive available tracking information after shipment.

If we cannot ship an order within the advertised timeframe, or within the period required by law when no timeframe is advertised, we will provide applicable delay, cancellation, and refund options.

6. Returns, Refunds, and Damaged Products

Because coffee is a consumable food product, we do not accept discretionary returns of opened coffee or returns based solely on personal taste preferences.

If an order arrives damaged, contains an incorrect product, or has another quality or fulfillment issue, please contact us at metal.memories.art@gmail.com, preferably within seven days of delivery.

Please include your order number, a description of the problem, and photographs when available.

We will review the issue and provide an appropriate replacement, refund, or other remedy in accordance with applicable law.

Nothing in this policy limits any non-waivable consumer rights.

7. Order Changes and Cancellations

Customers may not request an order change after purchase. All sales are final. Any cancellation or refund should be made by contacting metal.memories.art@gmail.com.

We will attempt to accommodate requests received before fulfillment begins, but changes cannot be guaranteed once an order has entered processing or shipping.

If an order is delayed or cannot be fulfilled, customers retain all applicable cancellation and refund rights.

8. Coffee Quality and Product Information

Coffee is a natural agricultural product. Flavor, aroma, color, and other characteristics may vary between batches.

Customers should review product descriptions, ingredient information, and packaging labels before consumption.

Customers with ingredient sensitivities should not consume coffee.

9. Lost, Delayed, or Incorrect Shipments

We may request relevant order and tracking information to investigate the issue with our fulfillment partner or shipping carrier.

Appropriate refunds, replacements, or other remedies will be provided when required by law or under our published policies.

10. Website Content and Intellectual Property

The Built By Coffee name, original branding, artwork, website content, and original product photography are owned by Metal Memories LLC or used with permission.

Unauthorized commercial reproduction or use of protected website content is prohibited except as permitted by law.

11. Privacy and Customer Information

Customer information is collected and processed to operate our website, complete transactions, fulfill orders, provide customer service, and perform other activities described in our Privacy Policy.

Necessary order and shipping information may be shared with payment processors, fulfillment partners, shipping carriers, and service providers.

12. Limitation of Liability

To the extent permitted by applicable law, Built By Coffee and Metal Memories LLC are not responsible for indirect or consequential losses arising from website use or product purchases.

Nothing in these Terms excludes liability or limits consumer rights that cannot lawfully be excluded or limited.
